The eighth hearing took place against the backdrop of the second week of Ruben Vardanyan’s hunger strike

The session was focused on procedural motions filed by the defense. Highlights of the hearing:

– To provide a translation of the decision on bringing charges.;

– To allow access to the video materials of the case;

– To provide a notice of rights and obligations;

– To allow access to the court hearing protocols.

Of these, the court granted the first and fourth motions.

The judge stated that document review would take place on March 5. However, after the hearing, a court officer informed the defense that it has been postponed until March 8.

Following the discussion of motions, the prosecution continued questioning regarding the charges. The defense refrained from answering.

Ruben was also visited by the Ombudsman of Azerbaijan, to whom he voiced all his concerns.

The next hearing is scheduled for March 11, 2025.

Siranush Sahakyan: “Ruben Vardanyan's problem becomes extremely humanitarian”

The defender of the interests of Armenian prisoners in the ECHR, lawyer Siranush Sahakyan explained why one cannot trust the words of the Azerbaijani Ombudsman Sabina Aliyeva, who visited Ruben Vardanyan and other Armenian political prisoners yesterday. The prisoners allegedly told her that they were satisfied with the conditions of detention, although recent photos of Ruben Vardanyan clearly show the opposite.

“No video material was published this time, probably to avoid showing the condition of Ruben Vardanyan after a 15-day hunger strike. Vardanyan’s case is special, his health is already clearly in danger. Despite this, even in this position he refuses to testify”, said Siranush Sahakyan.

In her opinion, the most important thing now is to convince Ruben Vardanyan to stop his hunger strike. Moreover, Sahakyan believes that it is necessary to do everything possible to apply urgent international humanitarian instruments.

В каких-то источниках я прочитала, что армянским бизнесменам нечего предложить за Вас, так как нужны просто огромные деньги или что-то взамен что потребует Баку, но у Армении нет таких ресурсов. Я думаю, что если бы это была правда вся диаспора за один, максимум 2 два собрала бы необходимую сумму, даже если речь о деньгах, которые я не могу представить, чтобы спасти Вас. Ruben Vardanyan's family lawyer Jared Genser called on the Armenian authorities to actively participate in the release of prisoners and explained what Nikol Pashinyan could do

Despite the lack of diplomatic relations between Armenia and Azerbaijan, what can Armenia do to help secure the release of the Armenian Christian political prisoners and POWs in Azerbaijan? Many people have asked how Armenia can help secure the release of these Armenian Christians detained in Azerbaijan given there are no diplomatic relations between Armenia and Azerbaijan. In fact, there is much more that can be done by Prime Minister Nikol Pashinyan and Foreign Minister Ararat Mirzoyan:

Public Statements and Public Diplomacy.
Prime Minister Pashinyan can build off the statements of the Foreign Minister and Foreign Ministry and issue a public statement that says that the release of the political prisoners and POWs by Azerbaijan is a top priority, that their detentions are politically-motivated, and they must be immediately and unconditionally released. And the Prime Minister could hold a press conference to discuss all these issues, publish an op-ed in a major paper, and speak out as major developments warrant.

Assist the Families.
Both the Prime Minister and Foreign Minister could request to meet with the families of the political prisoners and POWs to show their solidarity with them. They could also ask the International Committee of the Red Cross and Organisation for Security and Co-Operation in Europe (OSCE) to send trial monitors to the trials of Ruben Vardanyan and the others. They could also ask all their allies with embassies in Baku to send trial monitors as well. They could even ask Azerbaijan, despite the lack of diplomatic relations, to send Armenian Government observers to the trials.

Engage with Azerbaijan.
Prime Minister Pashinyan could send a private envoy to Baku to seek to open a humanitarian channel to negotiate the release of the political prisoners and POWs. In addition, he could work with a like-minded government, such as Switzerland, to set up an Armenian Interests Section at their Embassy in Baku to represent Armenia’s interests in Azerbaijan. Even if the issue of political prisoners and POWs will not be part of a peace agreement, the Prime Minister could make clear privately that their release must occur before or contemporaneous with the finalization of the deal.

Request Support of United States, France, and the European Union.
Prime Minister Pashinyan could ask President Trump and Secretary Rubio for their help, President Macron for his help, and EU High Representative for Foreign Affairs and Security Policy Kaja Kallas for her help in freeing the political prisoners and POWs.

Continue and Expand Legal Cases.
The Government can continue to pursue its legal cases before the International Court of Justice and European Court of Human Rights. It could also request the Prosecutor of the International Criminal Court to open a preliminary examination into the forced displacement into Armenia of the 120,000 Armenian Christian residents of Nagorno-Karabakh.

Engage Global Religious Community.
The Government can appeal for help to address the clear persecution of the Armenian Christian community in line with President Trump’s call for action – http://bit.ly/3FdHYre – both for the 120,000 that were summarily expelled from Nagorno-Karabakh and the current Armenian political prisoners being held in Baku as a result of their ethnicity and religion.

Engage Multilaterally.
– Prime Minister Pashinyan could appoint a special envoy to free persecuted Christians worldwide with a focus on working to secure the release of the political prisoners and POWs. He could join with 80 countries in the world and sign on to the Canadian-led Declaration Against Arbitrary Detention in State-to-State Relations.
– Prime Minister Pashinyan could ask UN Secretary-General Antonio Guterres and UN High Commissioner for Human Rights Volker Turk for help in securing the release of the prisoners and POWs on humanitarian grounds.

Protesters in Armenia demanded that the Red Cross visit Ruben Vardanyan and other Armenian prisoners in Baku

Hundreds of Armenians gathered for the protest in front of the Yerevan office of the International Committee of the Red Cross (ICRC). The protesters called on the ICRC to urgently intervene in the situation of Ruben Vardanyan, who has been on hunger strike for two weeks.

“His condition is already critical, which means that every second counts, and thus we are trying to ask the Red Cross to immediately visit Ruben Vardanyan and try to prevent a possible catastrophe”, Artsakh Culture Minister Narine Aghbalian said during the protest.

The representative of the Armenian office of the organization Zara Amatuni said that Ruben Vardanyan was visited when he was already on hunger strike.

“During the visit, one of the ICRC staff was a foreign doctor, and there was an opportunity for a neutral examination. However, the information we recorded is confidential and is provided only to the Azerbaijani, local authorities responsible for the conditions of detention”, Amatuni said.

The participants of the protest handed over a letter addressed to the Director of the ICRC with an appeal to organize a medical examination of Armenian prisoners in Baku. They demanded:

– to impartially assess the condition of Ruben Vardanyan and other Armenian prisoners and ensure that they receive the necessary assistance;

– to take measures to end Ruben Vardanyan’s hunger strike and at the same time examine the reasons that pushed him to such an extreme step;

– to report on the conditions and treatment of Armenian prisoners.

The letter was signed by representatives of about 40 NGOs.

On March 1, Mane Tandilyan, co-founder of the “Country for Life” party, started a hunger strike in support of Ruben Vardanyan. On Sunday, two more people joined her.

VIVA added that, in accordance with international standards, the defendant should be transferred to a hospital, where he will be looked after by qualified doctors.

«Неделю назад Рубен Варданян объявил голодовку в знак протеста против политического показательного процесса в отношении него и других армян – политзаключенных в Азербайджане. Процесс по делу Варданяна начался 17 января, примерно через 500 дней, которые он провел в заключении. Ему грозит пожизненное лишение свободы по политически мотивированным обвинениям. Кроме того, Рубен столкнулся с вопиющими нарушениями его прав.

Вчера над Варданяном продолжился суд, несмотря на ухудшение его состояния и просьбу об отсрочке. Рубен держит голодовку уже неделю, что сильно ударило по его здоровью. На данный момент он потерял 6 кг своего веса, у него зашкаливает пульс и держится высокое артериальное давление.
Варданян испытывает сильное головокружение и находится в предобморочном состоянии.

Несмотря на серьезные медицинские проблемы, Рубен всё же предстал перед судебной коллегией Бакинского военного суда. Учитывая его состояние, адвокат защиты подал ходатайство об отсрочке слушаний, и судебная коллегия разрешила сделать перерыв, чтобы Рубена осмотрел государственный врач.

Судебная коллегия отклонила ходатайство об отсрочке слушаний, заявив, что Варданян должен присутствовать на заседаниях при учете, что во время них он имеет возможность быть в сидячем положении.

Принуждение Рубена к участию в этом разбирательстве при наличии серьезных угроз его здоровью представляет собой пренебрежение международным правом, а также жестокое, бесчеловечное и унижающее достоинство обращение с подсудимыми.

Я призываю международные правозащитные организации, у которых есть доступ к заключенным в Азербайджане, в срочном порядке посетить Рубена Варданяна. Кроме того, я прошу независимых наблюдателей присутствовать на судебном процессе в Баку, чтобы зафиксировать любые нарушения прав.
 
Я прошу правительство Азербайджана допустить врача из нашей международной команды к Рубену в СИЗО для оказания необходимой медицинской помощи, включая регулярный мониторинг состояния, в котором он нуждается во время голодовки, и отложить судебный процесс до ее окончания.

Я также призываю мировых лидеров и премьер-министра Армении Никола Пашиняна, осудить незаконный судебный процесс против Рубена и других армянских политзаключенных».

Lilit Galstyan: “I propose to send a mission to Baku to ensure compliance with international legal standards and transparency of the process”

American intellectuals stood up in defense of Ruben Vardanyan

In an article in The Washington Post, David Ignatius, a well-known American journalist of Armenian origin, called on US President Donald Trump to protect persecuted Christians, and it is necessary to start with Ruben Vardanyan. According to another representative of the Diaspora, writer and economist Vahan Zanoyan, by doing so Ignatius reminded the new American administration of what happened to the Armenians of Artsakh and where Ruben Vardanyan is now.

As Zanoyan noted, completely ridiculous accusations were brought against Ruben Vardanyan, which have no connection with his worldview and life philosophy. The purpose of this absurdity is to take revenge on the entire Armenian nation.

The writer said that in the past as a friend he repeatedly persuaded Ruben Vardanyan to leave the blockaded region, but the latter said every time that he could not leave the Artsakh people to their fate. “In these cruel conditions and hard reality, he managed to remain a human being, and this is an exceptional quality,” Zanoyan noted.

The family of Ruben Vardanyan, an Armenian political prisoner, has conveyed his message to the international community after a brief phone call, in protest against the staged "judicial" process against him.

“Yesterday, I have decided to protest by declaring a hunger strike against the judicial farce being carried out against me. This is my response to the blatant violations of Azerbaijani procedural law and international law. What is happening in the courtroom cannot be called a trial – this is a political show, in which my right to a fair hearing is being deliberately disregarded.

For the past month, my local lawyer – Avraam Berman and I have tried to make it clear to the court that it is critical for me that this so-called “trial” be objective rather than a staged performance. Sadly, it has been clear from the beginning that this case is all about persecuting me as an Armenian simply for exercising my rights to freedom of opinion and expression and political participation under international law, which have been aimed at protecting the rights of the Armenian-Christian population of Artsakh.

Despite Azerbaijan being a State Party to the European Convention on Human Rights and International Covenant on Civil and Political Rights, this process has also been replete with egregious due process abuses:

  1. I am being tried in an illegal military tribunal and not a civilian court.
  2. I have not been granted full access to the indictment and so called “evidence” against me – 422 volumes in Azerbaijani, for which I was given only 21 working days to review, which have been classified as “state secrets.”
  3. The “indictment” presented to me is not an official document, as it lacks the signatures of my accusers. Even the translation of this so-called document contains gross errors, making it impossible for me to understand the charges against me.
  4. I have been denied my right to defense – my local lawyer, Avraam Berman, has had his access to materials restricted, his documents confiscated, and he has been subjected to psychological pressure. Further, my international legal team has been barred from communicating or visiting me and has not had access to any of the case materials.
  5. I have not been allowed to summon defense witnesses or file complaints regarding the violations committed during the investigation and trial.
  6. All of the hearings have been secret and closed to the public. Foreign journalists and independent international representatives have been barred from the courtroom.

This so-called ‘trial’ is not just against me. It is an attempt to criminalize all Armenians – all those who supported and demonstrated compassion toward Artsakh and its people, all those who showed compassion. This is an attack on an entire nation.

I refuse to participate in this farce.

I appeal to world leaders, international organizations, human rights defenders, and members of the press:

This process demands your attention. The imitation of justice is an endorsement of lawlessness and injustice. Silence in the face of such violations paves the way for future tragedies, fueling hostility and a new wave of hatred. Only through truth, law, and humanity can peace and justice be ensured in the region.”

At the fifth hearing at the Baku Military Court, the charges against Ruben Vardanyan were read out once again

During the hearing Ruben Vardanyan officially refused the services of the lawyer imposed by the Azerbaijani authorities, referring to the illegality of his appointment. The court accepted Ruben Vardanyan’s refusal and granted the motion.

Ruben Vardanyan’s local lawyer addressed the court with two questions. First, he drew attention to the fact that the new translation of the preliminary hearing decision again revealed serious inconsistencies. The document addressed only the motion requesting a postponement, but in fact there were several motions.

Second, the lawyer pointed out that he had not yet received access to the transcripts of the trial and demanded that an officially certified version be provided.

The court refused to consider these issues until the indictment was fully read.

Baku Military Court continued reading out the indictment in the case of Ruben Vardanyan

At the fourth hearing, the judge proceeded to read a multivolume document, much of it describing events unrelated to the philanthropist.

Ruben Vardanyan and his lawyer filed two motions. The court granted one of them: Vardanyan and his lawyer were allowed to confer in private.

Ruben Vardanyan also filed a motion to disqualify the judicial board. He pointed out that the panel ignored procedural violations at the investigation stage, showed disrespect for international law and made serious mistakes in translating the materials of the case.

Ruben Vardanyan’s lawyer backed up his words with references to legal norms and confirmed the procedural violations he had encountered during the investigation. However, the court did not consider the motion to disqualify the judicial board during the hearing.

Yesterday the third hearing on Ruben Vardanyan's case was held in Baku Military Court

The prosecutor began reading charges dating back to 1988. They obviously had nothing to do with Ruben Vardanian: at that time he was 19 years old and a full-time student at the Economics Department of Lomonosov Moscow State University.

Ruben Vardanyan and his lawyer filed several motions, but all of them were rejected by the court.

So far, less than 5% of the thousands of pages of the indictment and evidence have been orally translated for Ruben Vardanyan, and his local lawyer has studied only 20% of the materials.

In addition, Ruben Vardanyan’s lawyer filed a motion to disqualify the court-appointed interpreter after serious inconsistencies were revealed: for example, the translated decision on the results of the preliminary hearing contained references to the legislation of Belarus, which has no relevance to the case.

The next hearings in the case of Ruben Vardanyan will be held on February 10 and 13.

Conspiracy theories followed. Some claimed that Mr. Vardanyan had been sent by Moscow to turn the republic into a Russian protectorate, others that he was to facilitate its surrender to Azerbaijan. The simple explanation, that a person might aspire to something more than money and comfort, or be driven by romantic ideas such as patriotism or justice, seemed far less likely. And certainly less comfortable for those who had never been inspired by such ideas.

Conspiracy theories about Ruben Vardanyan continued even after Azerbaijan returned to Artsakh in 2023, ethnically cleansing its indigenous Armenian population, looting its churches and cemeteries, and liberating the land from Armenian presence for the first time in thousands of years. They continued even when Azerbaijan arrested Mr. Vardanyan himself, along with 15 other former officials.

And yet, as the trial of Armenian political prisoners begins behind closed doors in Baku, these few photographs show us something we cannot deny – something we recognize as historical memory. Deprived of a lawyer and water, emaciated to the bone, rejected by Russia that created him, ignored by the West whose values he romanticized, abandoned by his own Armenian government, standing for the last time to face his life sentence, Ruben Vardanyan looks at last like a real Armenian”.

No. It is easier for us to say that the son was just chilling in a sanatorium, not serving, and Ruben has just negotiated everything with either the Russians, or the British, or the aliens and Ilon Musk, and he will soon be released and given power over planet Earth, planet Saturn and half of Mars in addition.

We are all sinners, we are all mortal and we will all stand trial. And there will be no way to hide anything. Not a gray hair with paint, not a pimple with powder, not a hole in the conscience with money. You see, every man is just a man. Everyone has been given something and not given something. And I am not devaluing anyone’s actions by comparing them to Ruben’s. Everyone will be asked according to their abilities. Well, that is the whole point, to accept that we are different. And that there is someone who is cooler than you. Just cooler. Just the scale is different”.

“On the eve of the trial, political prisoner and Artsakh State Minister Ruben Vardanyan said that his lawyer and interpreter were forced to sign documents retroactively, including falsified protocols of interrogations that were not actually conducted. Ruben was not given the opportunity to get acquainted with the case in a language he understood, was tortured, forbidden to drink water and use toilet paper, and was subjected to other inhumane actions. And he is not the first to complain about prison conditions in Azerbaijan.

Vardanyan’s statement about violations of the lawyer’s defense and falsification of interrogation protocols is a serious violation that contradicts the fundamental principles of the right to a fair trial.

I would like to emphasize that Azerbaijan, violating the Geneva Conventions, refuses to return Armenian prisoners of war. The accusations against the former leadership of Artsakh and others are clearly political in nature. Allegations of terrorism and the establishment of illegal armed groups serve exclusively political interests and violate the norms of international humanitarian law.

In light of the above, I called on my international partners to demand that Azerbaijan comply with its international obligations and immediately return all Armenian prisoners to their homeland”.

“Recently Ruben Vardanyan was able to demonstrate to the public what kind of “criminal case” was fabricated by Azerbaijan and what kind of “trial” this country is preparing for him. “The case of Ruben Vardanyan, a philanthropist and former state minister of the unrecognized republic, is being considered in a military court. Vardanyan, who has spent almost 500 days in Baku pre-trial detention center, was given only 9 days to get acquainted with 422 volumes of the case.

If it seems to some that the surrealism of the situation ends here, it does not: things are even worse. Eva Merkacheva, a member of the Human Rights Council, recently stated that Ruben Vardanyan is being forced to change his own lawyer for a state one.

Let me remind you that after Vardanyan’s illegal detention in the Lachin corridor on September 27, 2023, Azerbaijan accused the philanthropist of financing terrorism, creating illegal armed formations and illegally crossing the state border of Azerbaijan. But over time, the number of charges increased 14 times to 42 articles. It is worth noting separately that out of 422 volumes of the case, only six are related to Vardanyan, and all the others examine in detail the history of Nagorno-Karabakh since 1987 (Ruben Vardanyan was 19 years old at that time, he was studying at Moscow State University).

All of the above turns the trial of the man nominated for the Nobel Peace Prize into a farce. Or Kafka’s “The Trial”. In civilized countries, of which Azerbaijan sees itself as an integral part, such work of the legal system would be simply impossible to imagine”.

Власти Азербайджана предъявили ему 42 обвинения, по некоторым из них социальному предпринимателю грозит пожизненное.

Среди прочего Рубену Варданяну вменяют финансирование терроризма, создание незаконных вооруженных формирований и незаконное пересечение границы Азербайджана. Мировая общественность считает эти обвинения абсурдными, так как в Нагорном Карабахе известный в мире социальный предприниматель занимался исключительно гуманитарными проектами. Обвинения в нарушении границ тоже звучат неубедительно: Варданян въезжал в НКР через Лачинский коридор, и на тот момент упомянутой границы просто не существовало.

В пользу абсурдности судебного процесса над Рубеном Варданяном говорит и тот факт, что его заставляют сменить собственного адвоката на защитника, которого предоставил Азербайджан.

Самое любопытное, что из 422 томов уголовного дела 416 посвящены подробной истории Нагорного Карабаха и разгоревшегося там конфликта, а на долю Рубена приходятся “жалкие” шесть томов. Хотя уже сейчас понятно, что внятной доказательной базы у Азербайджана нет. Вероятно, именно поэтому процесс в Баку пытаются провести в закрытом формате: несмотря на заверения в открытости, на слушании не присутствуют независимые журналисты и правозащитники».

“Ruben Vardanyan acted as a peacekeeper in the conflict in the unrecognized Nagorno-Karabakh Republic (another name for Artsakh). During the hostilities there in 2020, he asked Russian President Vladimir Putin to help resolve the military conflict. He also renounced his Russian citizenship in order to go to the field and head the government in Nagorno-Karabakh. Why did he do all of this? In his view, this was the only way to draw the world’s attention to the problem (there was nothing about it on the international agenda). He solved the issues of providing the residents of blockaded Artsakh with food, medical care and electricity.

And now there is the trial going on. I will share my thoughts.

The case of a man who did not participate in the hostilities in Karabakh is being heard in the Baku military court. This is strange. At the second court session Ruben was appointed a state lawyer. According to his family, they are trying to force him to change his own lawyer for a state lawyer.

Taking into account the events of the interstate conflict, the forcible imposition of a public defender from one of the parties on the accused looks ambiguous.

In itself, the state institution of the public advocacy is a strong humanistic initiative. But it is bad when such a mechanism is used to legalize the judicial process. A person must have a choice: a state lawyer or a non-state lawyer. “A person must have a choice: a state lawyer or a non-state lawyer. And this is especially important, as I think, when it comes to courts, which, both in terms of their content and the attention of the world community attached to it, have an international status”.

”I literally owe my life to Ruben.

When I was 16, I entered the international college in Dilijan founded by Vardanyan: from a small yard school in a dormitory neighborhood, I went to Hogwarts. Imagine: in a school on the outskirts of Dilijan (population 17,000), Ivy League professors teach, businessmen from the Forbes list give lectures, and the school’s official spokesman is George Clooney. I mean literally: here is George Clooney (who starred in the movies “From Dusk Till Dawn”, “Oh, Where Are You, Brother?” and “Ocean’s Eleven”) sitting in the front row at our graduation in the auditorium.

And I am not from a rich family, but one of the hundreds of students whom Vardanyan’s team gave a chance: teenagers from Ethiopia, Nigeria, Venezuela, Afghanistan, and about 70 other countries studied with me. Many of them learned for the first time only in Armenia, for example, what it is to live and not to starve. I am not even talking about the opportunity to get an education.

Vardanyan was once partly rightly considered a Russian oligarch, but at the decisive moment he took a different path: the path of investing not in golden ruffles, but in people, and I am living proof of that.

During his imprisonment, Vardanyan had already spent three weeks in a disciplinary cell, where he was deprived of food, water and the opportunity to change clothes. In his open letter, he said that the protocols of his interrogations were falsified, and his lawyers and interpreters signed them retroactively under extreme pressure.

Probably, one can have a different attitude towards Ruben Vardanyan. But damn it, he certainly does not deserve this”.

“The trial against Russian-Armenian philanthropist Ruben Vardanyan, a talented businessman who risked everything and headed the government of Nagorno-Karabakh, sincerely rooting for all its inhabitants, has started in Azerbaijan.

It is strange that the case of the former Artsakh premier is being heard by a military court and not a civilian one, although Vardanyan did not take part in military actions, but focused his efforts on the humanitarian situation in the blockaded region, for which he was later nominated for the Nobel Peace Prize.

Before the trial began, Vardanyan stated through his family that he had not given any testimony at all during this year and a half of the investigation, had not signed any interrogation reports, and had not even been allowed to get acquainted with the case file. It seems that the case, as they say, does not hold water. Ruben Vardanyan himself insists on his complete innocence.

Aliyev said that Moscow was interested in Vardanyan’s fate, Vladimir Putin urged Aliyev to show mercy to the prisoners. But there are no visible results of any work so far. It is a shame, because Vardanyan could seriously strengthen Russia’s position in the South Caucasus”.
